1. Introduction
Welcome to AdvertiseJobYako ("Platform," "we," "us," or "our"). By accessing or using our platform at advertisejobyako.co.ke, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Platform.
AdvertiseJobYako is a business advertising platform that connects service providers with clients across Kenya. We help you create professional profiles, showcase your work through portfolios, and reach new customers through automated social media marketing.
2. Eligibility
You must be at least 18 years old to use the Platform. By creating an account, you represent that you are legally capable of entering into a binding contract. The Platform is primarily intended for service providers and clients in Kenya, but is accessible globally where permitted by law.
3. Account Registration
You may register using your Google account or email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
We use Google OAuth 2.0 for sign-in. By using Google Sign-In, you also agree to Google's Terms of Service and Privacy Policy. Each user may create multiple business profiles under a single account.
4. Business Profiles
As a service provider, you may create one or more business profiles on the Platform. Each profile includes your business name, category, services offered, contact information, location, bio, portfolio images, and profile photos.
You are solely responsible for the accuracy of your business profile content. You agree not to:
- Post false, misleading, or fraudulent information
- Upload images you do not own or have permission to use
- Impersonate another business or individual
- Include offensive, discriminatory, or illegal content
- Include contact information intended to bypass the Platform
We reserve the right to review, suspend, or remove any business profile that violates these terms without prior notice.
5. Services & Categories
The Platform organizes service providers by categories (e.g., Mechanics, Plumbers, Electricians, Hair & Beauty, Photographers). You select a category and services when creating your profile. We may add, remove, or modify categories and services at any time.
6. Paid Subscriptions
Payments are processed in Kenyan Shillings (KES). Subscription fees are non-refundable unless required by law. You may cancel anytime — your subscription remains active until the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
7. Social Media Posting & Advertising
The Platform creates and publishes posts about your business on connected social media platforms including Facebook, Instagram, X (formerly Twitter), and TikTok. Posts are generated based on your profile information, services, and portfolio.
By enabling auto-posting, you authorize us to:
- Create and publish content on your behalf on connected platforms
- Use your business name, logo, portfolio images, and service descriptions in posts
- Run paid advertising campaigns using the ad budget included in your plan
You retain ownership of all content you upload. You grant us a worldwide, royalty-free license to use, display, and distribute your content for the purpose of promoting your business on the Platform and social media. You may disable auto-posting at any time.
8. Reviews & User Content
Clients may submit reviews of service providers. Reviews require email verification before publication. By submitting a review, you agree that:
- Your review is based on genuine experience with the service provider
- Your review does not contain false, defamatory, or offensive content
- We may display your review name and rating publicly on the provider's profile
Service providers may not remove negative reviews. We reserve the right to moderate, reject, or remove reviews that violate our content standards.
9. Intellectual Property
The Platform name, logo, domain, and all original code, design, and content created by us are our exclusive property. You retain ownership of your business information, portfolio images, and content you upload. We retain ownership of AI-generated captions and analytics derived from your account activity.
10. Termination
You may delete your account and business profiles at any time. We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if your account remains inactive for 12 consecutive months. Upon termination, your public profiles will be removed. We may retain anonymized data for analytics purposes.
11. Limitation of Liability
The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee:
- That the Platform will be uninterrupted or error-free
- That social media posts will reach any specific audience or generate any specific results
- The accuracy, reliability, or quality of any service provider listed
- That clients will engage or hire any service provider
To the fullest extent permitted by law, AdvertiseJobYako shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of business, revenue, or data.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
13. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes via email or a notice on the Platform. Continued use after changes constitutes acceptance.
